The situation is described by state officials as “best treated on a case by case basis.” Here are the concrete points for selling food items other than produce at farmers markets in Kentucky:

  1. The food items must have been prepared in an inspected facility.
  2. The facility selling the food must have the proper state permits to do so.
  3. The facility must also have the required local permits. These can vary widely across local jurisdiction.

Again, the best general outline out there so far seems to be Chapter 11 of The Legal Guide for Direct Farm Marketing. The best place to go after this general information is a state level office and your local regulatory offices. The local regulations are highly varied, so be sure to check in with the appropriate folks in your area.
