Plant Sales Licensing

If you deal with plants or plant material, such as a nursery, garden center, landscaper, sod producer or perennial grower, in Kentucky then you are required to have a nursery or nursery dealer license!! This license is above and beyond a business license.

"But I am not a nursery!"

You may not consider yourself a 'nursery'; but if you sell plants or plant material in Kentucky then you are required by Kentucky state law to have a nursery or nursery dealer license!! This license is above and beyond a business license.

"Why do I have to be licensed?"

Chapter 249.060 states: "Every resident nursery or dealer selling nursery stock in this state shall ANNUALLY file credentials with the state entomologist." and Chapter 249.010 gives the definitions (9, 10 a,b,c and 11) of those who are to be licensed.

Customers purchasing plant or plant products from a person or company they are doing business with should ask if they have one of the licenses listed below (compliant with Kentucky state law - KRS 249). Ask for proof of the license or contact Joe Collins before making any transaction(s).


Annual (fiscal) Nursery License Fee and License Period:
Class A and Class B Nurseries includes but are not limited to: individuals, nurseries, garden centers, landscapers, and landscape contractors.

Class A Nurseries: Jul 1 - Jun 30
If you or your business are actively growing nursery stock (field or container production).

$40/location + $1.50/acre in production

Class B Nurseries: Jul 1 - Jun 30
If you or your business does NOT grow nursery stock, but overwinters a portion of nursery stock

$40/location


Annual (calendar) Nursery Dealer License Fee and License Period:
Class A and Class B Nursery Dealers includes but are not limited to: individuals, nurseries, garden centers, retail stores, landscapers, and landscape contractors.

Class A Nursery Dealers: Jan 1 - Dec 31
If you or your business does NOT grow or overwinter your nursery stock but whose primary business involves the sale or planting of nursery stock.

$40/location

Class B Nursery Dealers: Jan 1 - Dec 31
If you or your business whose primary sales are NOT the sale of nursery stock.

$25/location

"I am not a nursery..."

"...but you say I still may need a nursery or nursery dealer license?"

Please read carefully, even if the business is not a "nursery", a license may still be needed.
