THE H-1B APPLICATION PROCESS

For positions requiring a master’s degree or Ph.D., an "Assessment for H-1B" form is the first step in the application process. This form must be completed by the hiring department. Individual candidates for H-1B status may not initiate the process. To receive the most current assessment form, contact Teresa Keller at teresa.keller@uky.edu or Maria Tovar mtovar1@uky.edu.

Departments seeking an H-1B for a position which requires a bachelor’s degree must first appeal to the Immigration Advisory Committee (IAC). To begin this process, contact Charlene Leach, Director of International Student & Scholar Services at charlene.leach@uky.edu  or H-1B Advisor Teresa Keller at teresa.keller@uky.edu . If the appeal is denied, the H-1B process may not be sought through any other means. If the appeal is approved, the H-1B application will require the services of an attorney.

To comply with university policy, departments should inform their candidates that obtaining H-1B status on their behalf does not obligate the university to sponsor the employee for permanent residence. Such sponsorship is left to the discretion of the hiring officials.
