SPORTS LAW

Fall 1998

1. An out-of-town newspaper has carried a column indicating that the Ohio State Board of Pharmacy is investigating the team - the Bengals. You are one of the team's attorneys. The owner calls you and asks you to be prepared to discuss this matter with him. What specifically do you suggest be done? What talks do you want given to the players by physicians? What do you want to say to the players and coaching staff? What press releases do you believe should be prepared? (30 minutes).

2. What philosophy of sports agency did I suggest to you? What behaviors did I focus on? (20 minutes).

3. The Indianapolis Colts and Jimmy Baugh have sued Harry Margovitz individually and as president of the Mexico City Maulers. There are no jurisdictional issues. Margovitz was Baugh's agent, but was also simultaneously part owner of the Maulers. Baugh has signed a contract with the Maulers. He now seeks to rescind because of fraud. He did not know of Margovitz's position. The fact is that Indianapolis has now offered him a one million dollar contract. The suit has been filed five days before the Maulers' season is to begin. You represent Margovitz and the Maulers. What arguments would you be prepared to make in court on their behalf? What arguments do you anticipate that Indianapolis and Baugh will make? (30 minutes).

4. A long pass is thrown down field at a college football game. A paraplegic seated 12 feet beyond the sideline is run over by a receiver who does not catch the ball. The paraplegic was placed in that spot by the stadium attendant. He suffers a severe neck injury.
