Marcy D. Deaton is an Associate General Counsel in the Office of Legal Counsel at the University of Kentucky. She has more than twenty years of legal experience in private practice and public service, including eleven years at the University. In her current position she advises the University in the areas of higher education law and regulatory issues, University Governing Regulations and Administrative Regulations, faculty-related rules and regulations, accreditation requirements of the Southern Association of Colleges and Schools (SACS), contracts, and copyright. She serves as a University hearing officer for administrative hearings and is the legal advisor to the Residency Appeals Committee. She chairs the University Regulations Review Committee and oversees the development process for University regulations and policy.
Prior to assuming her present position in the Office of Legal Counsel, Marcy served the University as the Corporate Compliance Officer for UK HealthCare. As Corporate Compliance Officer she was responsible for ensuring UK HealthCare’s compliance with a myriad of state and federal health care laws and issues, such as the Health Insurance Portability and Accountability Act (HIPAA), the Emergency Medical Treatment and Active Labor Act (EMTALA), Medicare and Medicaid billing requirements, the False Claims Act, anti-kickback and STARK laws, vendor relationships, and research compliance issues.
Before she joined the University of Kentucky, her professional focus was workers compensation law. She was the Chief Legal Counsel for Kentucky Employers Mutual Insurance (KEMI), a Kentucky state agency that provides Workers’ Compensation Insurance to high risk Kentucky employers. At KEMI she oversaw regulatory compliance, workers claims litigation, collections, and the fraud investigation unit. She also served as an assistant general counsel for the Kentucky Department of Workers Claims in Frankfort, Kentucky, where she represented the Department at public and administrative hearings, managed the utilization review and medical bill audit program, and drafted legislation, administrative regulations, and judicial opinions. She began her legal career in private practice at the Lexington, Kentucky law firm of Rosenbaum and Rosenbaum, P.S.C.A native of Paintsville, Kentucky, Marcy received her undergraduate degree in English from Transylvania University, 1986. She studied government and politics at the American University in London, England, 1984. Her law degree is from the University of Kentucky College of Law, 1989. She is married to Frank A. Butler, Project Director for the Rupp District Project, Lexington Center Corporation. She has two college-aged children. She has a Kentucky Real Estate Sales License, and currently serves on the Boards of the Fayette County Bar Association Foundation and the Bell Court Neighborhood Association.
